I was performing a physical audit for Worker's Compensation at a saw sharpening entity and the owner was convinced that outside sales employees that delivered the saw blades back to their customers (usually local saw and paper mills) should be classified as 8742. I explained that unfortunately since 8742 includes those that do not deliver, class 8742 could not be used but 7380 - Drivers would be the class code that would be appropriate with the exposure. Please note that the insured's governing class code 3118C - Saw Sharpening does not include the wording & drivers so 3118 is not appropriate either. The insured advised that he was explained the class code by his agent and his agent advised that he could use 8742 for outside sales employees. He was cussing and really throwing a fit. I asked him to get the agent on the phone and let's talk about it. I was also apologizing to the insured that he must have misunderstood or maybe there was something I didn't know so he would feel I wasn't totally against him, just trying to do the right thing. The agent was put on speaker phone and advised the insured that he must have misunderstood because he did not realize the outside sales employees were also delivering saw blades. The agent agreed with the auditor and the insured apologized. At the end of the audit, he shook my hand and said thank you for getting to the bottom of it because he was thinking of leaving his carrier over it but now, he will see how the current year is handled before he makes any decisions.
