In April 2024, Orgain won a judgment against Iovate after alleging the Canadian firm infringed its trade dress on certain containers. Since the judgment, Orgain has attempted to enforce the award by seizing goods from the debtor's major customers, including Walmart, Amazon and GNC, according to the declaration. In June, Orgain received a writ of garnishment against Walmart that Iovate failed to quash. Iovate also received letters from its lenders in August demanding immediate repayment of debt. The investors noted that their collateral could be at risk because of Orgain's writ of garnishment.
